The National and States Assemblies Elections Petitions Tribunal, sitting in Sokoto, on Monday dismised the petition filed by the defeated Candidate of the Peoples Democratic Party ( PDP ) , in the Sokoto State House of Assembly Elections into the Sabon Birni South , Two , Constituency , Hon. Adamu Gado Gatawa ,against the declaration of Hon. Sa’idu Neno Ibrahim, of the All Progressives Congress (APC), as the winner by the Independent National Electoral Commission (INEC).
Gatawa had challenged the election of Ibrahim and alleged that , he has not acquired the required Secondary education , hence , not qualified to contest the election .
Gatawa , also among others , alleged that , the election was invalid by reasons of substantial non compliance, as well as the breach of the extant electoral laws of the country .
He also alleged that , the APC Lawmaker was not duly elected as he has not scored of the lawful votes cast.
Hon . Sa’idu has insisted that , he was lawfully declared as the winner of the election which was conducted by INEC on the 9th of March ,2019, and he was qualified to contest same .
In his Judgment, a member of the Tribunal, Justice Hamman Idi Polycap, averred that , Hon. Ibrahim’s election was conducted in substantial compliance with the Electoral Act, 2010, as amended , as well as INEC’s Electoral Guidelines for the conduct of the 2019 General Elections.
Justice Polycarp further submitted that , the Petitioners have failed to establish the allegations made in the petition, beyond reasonable doubt.
He therefore dismissed the petition for want of merit , but ,without awarding costs , or any further orders .
Reacting to the Judgement, the Victor, Hon . Ibrahim expressed gratitutide to the Almighty Allah, the Party and supporters for their sustained support .
He stated that , the victory will spur him to provide credible representation to his constituents who have always been confident in him.
Hon. Ibrahim also solicited for their sustained prayers and support to him and the party, at all levels .
Meanwhile, the Tribunal has dismissed the petition against the election of the PDP Lammaker, representing Sokoto South , Two , Constituency , Hon. Mohammed Malami Ahmed , filed at the Tribunal by the APC Candidate, Hon . Aminu Garba Gidadawa .
In his Judgment , a member of the Tribunal, Justice I. Iwodi , submitted that , the Petitioners have failed to prove the allegations made in the petition, beyond reasonable doubt.
